Metal Identifier - Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Metal Identifier - AI Scanner mobile application (the "App") operated by BamBam LLC ("we", "us", or "our"), a limited liability company registered in the State of Wyoming, USA.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App. We may update these Terms from time to time, and your continued use of the App after any changes constitutes acceptance of the revised Terms.

2. Description of Service

Metal Identifier is an AI-powered mobile application that allows users to take or upload photos of metals and receive an AI-generated identification and analysis. The App uses artificial intelligence models accessed through third-party services to process images and return results including the type of metal, properties, and related information.

The service includes a free tier with a limited number of scans, as well as paid subscription plans (Basic and Pro) that offer additional scan quotas and features.

3. Account Registration and Responsibility

To use the App, you may be required to create an account using your email address, Google Sign-In, or Apple Sign-In. You are responsible for:

4. Subscriptions and Billing

Subscription plans. The App offers Basic and Pro subscription plans available on a monthly or annual basis. Details of each plan, including pricing and included features, are displayed within the App at the time of purchase.

Payment processing. All subscription purchases are processed through Google Play (Android) or the Apple App Store (iOS). Your payment method on file with the respective store will be charged at the time of purchase. We do not directly collect or store your payment information.

Auto-renewal. Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. The renewal charge will be applied within 24 hours prior to the end of the current billing period at the same rate as the original subscription.

Cancellation. You may cancel your subscription at any time through your Google Play or Apple App Store account settings. Cancellation takes effect at the end of the current billing period; you will retain access to subscription features until that time. We do not offer refunds for partial billing periods.

Refunds. Refund requests are handled by Google Play or the Apple App Store in accordance with their respective refund policies. Please contact the relevant store directly for refund inquiries.

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

The App and its original content, features, and functionality are owned by BamBam LLC and are protected by copyright, trademark, and other intellectual property laws. Our trademarks, trade names, and trade dress may not be used in connection with any product or service without our prior written consent.

You retain ownership of any photos you submit through the App. By submitting a photo for analysis, you grant us a limited, non-exclusive license to process that image solely for the purpose of providing the metal identification service. We do not claim ownership of your photos and do not permanently store them on our servers.

7. Disclaimer of Accuracy

AI results are informational only. The metal identification results provided by the App are generated by artificial intelligence and are intended for informational and educational purposes only. Results should not be relied upon as professional, scientific, or certified assessments.

We do not guarantee the accuracy, completeness, or reliability of any identification result. AI-generated results may be incorrect, incomplete, or misleading. You should not make financial, safety, or other critical decisions based solely on the App's results.

If you require a definitive metal identification or valuation, consult a qualified professional such as a metallurgist, assayer, or certified appraiser.

8. Limitation of Liability

To the maximum extent permitted by applicable law, BamBam LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the App.

In no event shall our total liability exceed the amount you have paid to us through the App in the twelve (12) months preceding the claim. If you have not made any payments, our maximum liability shall not exceed fifty US dollars ($50.00).

This limitation applies regardless of the theory of liability, whether based on warranty, contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify, defend, and hold harmless BamBam LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without prior notice, for conduct that we determine violates these Terms, is harmful to other users or the App, or is otherwise objectionable.

Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.

11. Third-Party Services

The App relies on third-party services including Firebase (Google), RevenueCat, OpenRouter, Google Play, and the Apple App Store. Your use of the App is also subject to the terms and privacy policies of these third-party services. We are not responsible for the availability, accuracy, or practices of any third-party services.

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Material changes may also be communicated through the App or via email. Your continued use of the App after any modifications constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BamBam LLC regarding your use of the App, and supersede any prior agreements or understandings.
